1. Scope
1.1 These General Terms and Conditions apply to all contractual relationships between the dance school (“Dance School”) and its members and other participants.
1.2 Any deviating or additional individual contractual agreements shall take precedence over these GTC.
1.3 The Dance School offers dance classes, trainings, workshops, conventions, projects, teams/formations and other dance-related services. There is no entitlement to specific class times, instructors, or group compositions.
2. Subject Matter / No Employment Relationship
2.1 The subject matter is participation in the services offered by the Dance School according to the booked membership, single booking, or event.
2.2 This contract expressly does not constitute an employment, apprenticeship, or similar relationship.
3. Conclusion of Contract
3.1 The contract is concluded by:
• completing the booking via app or webshop, or
• completing the booking on-site at the Dance School premises.
3.2 The Dance School is entitled to substitute or change instructors for objective reasons.
3.3 Classes depend on a minimum number of participants. If the minimum is not reached, the class may be cancelled; in such case, credit points will be refunded.
4. Memberships, Terms & Termination
4.1 Terms
The following membership models are offered:
• 12-month contracts
• 24-month contracts
• team/formation memberships (12 months)
4.2 Extension
After the initial term, the membership continues for an indefinite period with a one-month notice period, unless terminated in due time.
4.3 Termination
• Termination is possible:
◦ via the app, or
◦ in text form by e-mail to info@openarea-dance.com
• The decisive factor is receipt of the termination notice within the deadline.
4.4 Note on purchasing memberships
Memberships can be purchased via the online shop or directly from the Dance School’s service staff.
4.5 Ordinary termination by the dance school (after initial term)
After the agreed initial term has ended and during the indefinite term, the dance school may terminate the membership without stating reasons by giving one month’s notice.
4.6 Relocation does not justify extraordinary termination
A change of residence/relocation (e.g., moving house, job-related transfer, extended stay elsewhere) generally does not constitute good cause for extraordinary termination.
5. Right of Withdrawal (online contracts only)
5.1 For consumer contracts concluded exclusively online (app/webshop), a 14-day right of withdrawal applies.
5.2 No right of withdrawal applies to contracts concluded on-site, as they are not distance contracts.
5.3 The right of withdrawal expires early if the member expressly agrees that classes start before the withdrawal period ends and the service has already been provided.

6. Prices, Payment & Default
6.1 All prices apply per person and are non-transferable.
6.2 A one-time registration fee of EUR 49.90 is charged upon initial registration.
6.3 Monthly fees are due on the 1st, at the latest on the 5th of each month, and are collected by SEPA direct debit.
6.4 Returned debits & additional costs
• Any returned debit fees will be recharged to the member in the actual amount incurred.
• Postage, processing and bank fees may also apply.
• If payment is not made after a reminder and a formal notice, reasonable reminder fees may be charged.
6.5 Default
• In case of payment default, the Dance School may temporarily exclude the member from classes.
• The contract remains unaffected.
• Outstanding fees remain payable and must be settled in full at a later date.
6.6 Fees related to course bookings
Fees for late cancellations, no-shows, or late check-ins under clause 7 will be invoiced and become due upon issuance of the invoice.
7. Credit Points, Tickets & Cards; Booking, Capacity and Cancellation Rules
7.1 Credit points (memberships)
• Credit points are credited monthly according to the selected plan.
• Validity is two months.
• Unused points expire automatically.
• Credit points do not apply to formation/team trainings.
7.2 Single classes, day passes & 10-class cards
• Single classes, day passes and 10-class cards are valid for 12 months from the purchase date.
• Payouts or transfers are excluded.
7.3 Booking window and capacity limit
a) Booking window: Regular schedule classes can be booked up to 7 days in advance.
b) Capacity limit: The Dance School enforces a binding room capacity limit. Once the maximum number of participants is reached, the class is marked as full and further bookings are blocked.
c) Waitlists / moving up: If waitlists are offered, places may become available through timely cancellations; there is no entitlement.
d) Trial classes: Trial class availability may be limited due to capacity and system constraints; there is no entitlement to participate when the class is fully booked.
7.4 Acceptance of booking and cancellation rules
With each course booking, the participant confirms having read and accepted the applicable booking and cancellation rules.
7.5 Free cancellation up to 6 hours before class start
Cancellations for regular schedule classes are free of charge up to 6 hours before the class start time. In this case, the used credit point (or equivalent entitlement) is re-credited. The class start time is decisive (example: class at 6:00 p.m. → free cancellation until 12:00 noon).
7.6 Late cancellation
If cancellation occurs later than 6 hours before class start, a fee of EUR 5.00 will be charged and invoiced.
7.7 No-show
If the participant does not attend without cancelling, a no-show fee of EUR 10.00 will be charged and invoiced.
7.8 Late check-in (booking after class has started)
If a participant registers/checks in after the class has started, a fee of EUR 5.00 will be charged and invoiced.
7.9 Clarification regarding any earlier 24-hour rule
Where earlier versions or other notices referred to a 24-hour cancellation period, for regular schedule classes the rules in 7.5 to 7.8 apply exclusively, unless expressly stated otherwise for specific services (e.g., workshops/events under clause 8).
7.10 Note: internal fairness/bonus model
The Dance School may run internal projects and remuneration models (e.g., instructor bonuses for fully booked classes). This creates no entitlement for members/participants to specific class operation, capacities, bookability or any other services.
8. Workshops, Conventions & Events
8.1 For workshops, conventions, intensives, projects or other special events:
• After booking, refunds of participation fees are excluded.
8.2 An exception applies only if the requirements of clause 9 are met.
9. Special Termination for Health Reasons
9.1 Requirements / proof of inability to exercise
Extraordinary termination or refunds for health reasons are only considered if a current medical certificate confirms that the participant is unfit to exercise/train and therefore cannot use the dance school’s services for a substantial period. The key question is whether continuing the contract until the regular end date is unreasonable (§ 314 German Civil Code).
9.2 Content of the certificate (duration required)
The certificate does not need to include a diagnosis. However, it must explicitly confirm inability to exercise and state an expected duration (a specific end date or time period). A vague statement such as “until further notice” may be rejected as insufficiently specific.
9.3 Specialist certificate (only if justified)
Where necessary for a plausibility check, the dance school may request a specialist doctor’s certificate in justified individual cases (especially where the alleged inability to exercise typically falls within a specific medical specialty).
9.4 Exclusions / short-term limitations
Pre-existing conditions known to the member prior to signing do not justify extraordinary termination. Temporary illnesses/injuries generally do not justify termination or refunds; however, the dance school may allow a temporary pause of credit points on a case-by-case basis.
10. Minors
10.1 Minors may only be registered by their legal guardians.
10.2 The Dance School assumes no general duty of supervision outside class times.
10.3 Responsibility for travel to/from the premises, waiting times, and staying outside class times lies entirely with the guardians.
10.4 Guardians are recommended to remain nearby or reachable during class times.
11. Identity Verification
11.1 The Dance School may verify the identity of the participating person at any time.
11.2 Presentation of a valid ID card or comparable official document may be required.
11.3 The verification serves to ensure contractual compliance and is carried out by service/administrative staff.
12. House Rules, Shoes & Use of Premises
12.1 Shoes & hygiene
• Street shoes must be removed in the entrance area and placed in the designated racks.
• Shoes worn outdoors even once must not be worn inside the Dance School area.
• In dance rooms, only indoor dance shoes, socks, or bare feet are permitted.
12.2 Clothing & personal belongings
• Clothing, bags, backpacks etc. must be stored in the designated boxes in the changing rooms.
• Valuables (e.g., phones, keys) may be taken into the dance room.
• The Dance School assumes no liability for items left behind.
12.3 Restricted areas
• Areas marked “Private” may only be entered by Dance School staff.
13. House Rules & Exclusion
13.1 Instructions from instructors and service/administrative staff must be followed at all times.
13.2 Violations of house rules, repeated disruption or disrespectful behavior may result in exclusion from classes; the contract remains unaffected.
14. Liability
14.1 Participation is at one’s own risk.
14.2 The Dance School is liable only for intent or gross negligence and for injury to life, body or health.
14.3 No liability is assumed for items brought in.
15. Photo & Video Recordings / Copyright
15.1 Class content and choreographies are protected by copyright.
15.2 The Dance School may use photo/video recordings for advertising and documentation purposes.
15.3 Any objection must be communicated before recording starts.
16. Force Majeure & Operational Disruptions
16.1 In cases of force majeure or official orders, classes may be suspended in whole or in part.
16.2 In such cases:
• credit points may be paused and credited later
• ongoing payments may continue to cover operational costs
17. Amendments to the GTC & Prices
17.1 The Dance School reserves the right to change prices and these GTC.
17.2 Changes will be communicated to members in due time.
17.3 Members may object and continue the membership on the previous conditions until the regular end of the contract term.
18. Dispute Resolution
The Dance School is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
19. Jurisdiction & Final Provisions
19.1 German law applies exclusively.
19.2 Place of jurisdiction is Hamburg, insofar as legally permissible.
19.3 If any provision is or becomes invalid, the remaining provisions remain unaffected.
